CGV: The use of the site www.centralefillers.com implies full and unconditional acceptance of the general terms of use described below. These terms of use may be modified or supplemented at any time, so users of the site www.centralefillers.com are invited to consult them regularly. This site is normally accessible at all times to users. However, we may decide to interrupt access for technical maintenance reasons. Of course, we will strive to communicate in advance to users the dates and times of the intervention. The site www.centralefillers.com is updated regularly. Similarly, we may frequently modify the legal notices: that is why we invite our users to refer to them as often as possible in order to be informed. We may transmit information to our partner laboratories according to material vigilance and at our discretion to improve the services and products offered.

2. Description of the services provided

CGV: The website www.centralefillers.com aims to provide information regarding all the activities of the company. We are an online sales site for hyaluronic acid-based filling products and cosmetic products. CENTRALE FILLERS is located at 73 allée Kléber, 34000, Montpellier. We order products from the laboratories present on our site (traceability guaranteed with the CE mark, batch number, and a valid expiration date visible on each product). From the immediate payment of orders by the various payment methods available on our site (credit card, PayPal, bank transfer, etc.), we carry out our deliveries through our shipping partners (Colissimo, Chronopost, etc.) as quickly as possible. We provide advisory and customer service via chat, email, and phone to assist all our clients effectively. Any order placed on our site commits the Client to pay the amount corresponding to their order immediately. In case of delay and/or non-payment, legal action may be taken where applicable. Minimum shelf life sold on our site Products with a shelf life (DLC) of 3 months. CENTRALE FILLERS reserves the right, upon request from its clients, to sell products with a shelf life exceeding (DLC) 3 months.
Delivery Time and Options
All delivery options offered are visible to customers based on the destination country and the specifics of the customer address. The specified delivery time is solely attributable to our carrier partners. CENTRALE FILLERS reserves the right to deliver within a timeframe of its choosing, depending on the time required to obtain our products from the laboratories present on this site. CENTRALE FILLERS strives to provide information as accurate as possible on the site www.centralefillers.com. However, we cannot be held responsible for omissions, inaccuracies, and deficiencies in updates, whether due to our actions or those of third-party partners who provide us with this information. All information provided on the site www.centralefillers.com is for informational purposes only and is subject to change. Furthermore, the information available on the site www.centralefillers.com is not exhaustive. We have made it available online and it remains subject to future modifications.

3. Return and Refund Policy

Withdrawal period

CENTRALE FILLERS grants a maximum withdrawal period of 14 days from the receipt of goods by its customers. CENTRALE FILLERS reserves the right to issue a refund after the recovery of the goods and after confirming that their condition remains unchanged. When the deadline falls on a Saturday, Sunday, or public holiday, it is extended until the next business day.

Reimbursement Method

The refund can be processed using a payment method similar to that used for the purchase. However, it is possible to carry out the transaction through another payment method, according to the prior agreement established between the buyer and CENTRALE FILLERS in order to avoid any additional fees.

Delivery Charges

Centrale Fillers also commits to reimbursing the buyer for delivery costs in accordance with Article L121-20-1 of the Consumer Code. However, return shipping costs remain the responsibility of the customer unless explicitly stated in the chapter "Terms of Refunds and Returns - Disputes". In the case of returning only part of the order, according to the opinion expressed by the DGCCRF in November 2008: shipping costs depend on the number of items ordered (weight per shipment), CENTRALE FILLERS may issue a pro-rata refund for the items returned by its customer.

If the customer has products shipped outside of France, they may be required to pay import duties upon receipt of their products. CENTRALE FILLERS cannot control these fees and cannot predict their amount. The buyer will be responsible for the payment of these taxes and customs duties not included. The customer can contact their local customs office for more information before placing their order.

 

Right of Withdrawal - Proof Required

The buyer must prove that he has complied with the legal withdrawal period (14 days). He can do this by contacting us in several ways:

To best address your request, we recommend including the reason, the desired action (refund or return of your order), the method of delivery for the return of the order (if applicable), the method of refund (if applicable), as well as your personal information (First name, Last name, and phone number to reach you).

The terms of return of the item

Centrale Fillers may request a return shipping number in order to maintain the traceability of returned products.

Refund and Return Terms - Disputes

In case of loss, damage, or defective products

Upon receipt of physical proof of loss, damage, or defective products, CENTRALE FILLERS may reimburse its customers on a pro-rata basis for the affected and/or returned products. CENTRALE FILLERS reserves the right to defer the actual reimbursement of the order until the receipt of physical proof of damages and/or defective products. Once received, we commit to reimbursing the return shipping costs along with the remaining amount of the concerned order. CENTRALE FILLERS may offer reimbursement of the order according to the specified conditions or resend the concerned order with the customer's agreement. In the case of loss/theft of a package, with a carrier's flashing certificate, CENTRALE FILLERS reserves the right to decide whether or not to reimburse the order. CENTRALE FILLERS reserves the right to offer a partial refund in the form of a credit note.

In case of order errors / expired products

CENTRALE FILLERS commits to refunding the order or returning it upon receipt of physical proof of the dispute: The proper receipt of the package and the products from the aforementioned order. We will reimburse you for the return shipping costs as well as the refundable amount of the disputed order.

Change of mind (without any other reason) without opening the product

We will leave the return shipping costs and the delivery charges of the dispatched order to the customer's expense. We reserve the right not to refund or accept the return of the concerned order in the event that the customer has damaged the products contained in the package. The return shipping fee is a flat rate of €6 excluding tax in France, €10 excluding tax within the EU, €15 excluding tax in Switzerland, and on a case-by-case basis internationally depending on the destinations.

Change of mind (without any other reason) after the items have been opened

We will not accept any refunds or returns. We provide sterilized medical devices for single use that must be under the recommended supervision of a healthcare professional. These products must remain unused with intact storage. For returns of packages from international locations (countries outside the E.U) CENTRALE FILLERS reserves the right to refund or not refund customs fees and additional taxes generated by the return of the package to French territory.

Assurance Central Fillers

In case of theft or loss of your package, you should not wait for the legal period to resolve the situation (up to 90 days). You simply need to report the package as lost or damaged via email. Following the investigation of your shipment, we will then send you a new package.

Under no circumstances does the insurance Centrale Fillers allow for the immediate reimbursement or reshipment of lost/stolen packages without proof. It cannot be refunded in the case of a resolved dispute. 

Insurance allows for a faster process for quicker investigation follow-up and ensures faster and more efficient transportation even in the event of incidents beyond our control.

 

4. Contractual limitations on technical data

It is also necessary to specify in our general terms and conditions of sale that the site uses JavaScript technology. We cannot be held responsible for material damages related to the use of the site. Furthermore, the user of the site agrees to access the site using recent hardware, free from viruses, and with an up-to-date latest generation browser.

5. Intellectual Property and Infringements

We prohibit any reproduction, representation, modification, publication, adaptation of all or part of the elements of the site, by any means or process used, without prior written permission from: CENTRALE FILLERS. We will consider any unauthorized exploitation of the site by a visitor as constitutive of infringement and pursued in accordance with the provisions of articles L.335-2 and following of the Intellectual Property Code.

6. Limitations of Liability

Terms and Conditions: We cannot be held responsible for direct and indirect damages caused to the user's equipment when accessing the site www.centralefillers.com due to the use of equipment that does not meet the specifications indicated in point 4, or due to the occurrence of a bug or incompatibility. CENTRALE FILLERS also cannot be held responsible for indirect damages (such as loss of market or loss of opportunity) resulting from the use of the site www.centralefillers.com. Centrale Fillers reserves the right to delete, without prior notice, any content posted in this space. 9. Applicable law and jurisdiction

Any dispute related to the use of the site www.centralefillers.com is subject to French law. The competent courts of Montpellier have exclusive jurisdiction over this document.

In this regard, in France, since the decree applicable from July 1, 2024, sales will be reserved exclusively for physicians and dental surgeons through validation of the RPPS number and after verifying that the delivery address matches the practitioner's office. 

With the exception of B2B sales, for which the following will be required:
- A KBIS of less than 3 months or a validation via API of the company's SIRET number
- A sworn statement that the company is registered with the ANSM for its activity of resale to doctors and dental surgeons.
- A verification (or pre-filling) of the delivery address against the registered office / secondary establishments of the entity.

These steps will always be required to ensure compliance with French law.
